General rules

SMS services are subjects to legal restrictions. Before setting up and promoting such services, service providers are strongly advised to examine the laws of corresponding countries that regulate advertising and interaction on the Internet. Below we list general rules & recommendations for non-erotic, non-gambling and non-medical services.
 
Your payment window should contain:

  • The name and type of your service, e.g. “Service "VIDEO per SMS" is the digital content distributor”.
  • End-user support contact (you may use our end-user support).

General terms:

  1. Allowed languages for PSMS-services: English
  2. Every partner that is involved with the provision of mobile premium services in Australia has to register for the Mobile Premium Services (MPS) Industry Code, prior to undertaking any business in AU!
  3. The tariff must be legibly communicated beside the Keyword and the Short-Code
  4. Pricemark should be specified incl. VAT
  5. There should always be a phrase “This service is provided by <company name>. A fee of <Tariff (how many SMS in case of multibilling)> will be charged on your mobile phone. This is not a subscription. Users must have sufficient credit to access this service. If you are minor, please ask permission from the bill payer before sending these messages. 24h Customer Service: 1300-724-063”
  6. Support via e-mail address or contact form. Helplines must be Australian standard-rate or a free helpline number and also provide a Live agent between the hours of 9am to 5pm, Monday to Friday.
  7. You are obliged to show your ads to AOneBill before launching the service.

Requirements for special types of services:

  1. Micropayment allowed
  2. Possible Tariffs for sweepstakes: 0,50 AUD - 1,50 AUD (the Tariff depends on the service! The practicability must be checked by AOneBill before the setup of the service). You have to communicate a deadline for entries.
  3. Gambling/casino is forbidden.

  7. You should show AOneBill all promotion materials before launching the service.

Regulations for specific types of services:

Specific types of services:

  1. Microbilling is allowed, but you should specify how many SMS an end user is supposed to send to get the service.
  2. Services under additional regulations: erotic content payments, job offers, mobile content distribution (special short codes), donation services (special short codes). Lotteries are acceptable in Bulgaria, but in general needs gambling permission from state commission. Still some lotteries for small prices are acceptable without license. As situation is very delicate with lotteries, we must have ALL information for that kind of services in prior.
  3. Gambling services are forbidden unless you have explicit permission from Gambling commission.   4. Terms & Conditions should include:

  7. When the mobile user registers on your website, present them with a box that they must affirmatively check before proceeding, “Accept Terms and Conditions”. This box cannot be pre-checked – the user must affirmatively check a box or click a button to agree.

Due to operators’ established firm policy you cannot display, advertise or promote that your SMS service is “Free” or that you are delivering “Free” content. Bottom line is that you cannot have the word “Free” on your website or in your SMS messaging, or your program will be rejected.

  1. The following elements are always to be included in any marketing of mobile content and payment services, regardless of the medium:
    • The type of service, e.g. “Vote for…”, “Take part in voting to decide…”, “Take part in a competition to win…”

    • The name, address and telephone number of the service provider.
    • Details of the procedure for terminating subscription-type services.
  2. Include the information concerning the customer’s right for the 14-day cooling-off period. If the end-user maintains his or her 14-day right to withdraw, there is no need to provide information on this right. If the customer is to waive his or her right to withdraw (cooling-off period), specify: “By sending the text, you agree that your right to withdraw ceases to apply under the terms of the Danish Consumer Contracts Act” or “By taking part, you waive your right to a 14-day cooling-off period” or “By participating, you renounce your right to a 14-day right to withdraw”. (Note that the mere inclusion of the words “no right of withdrawal” is insufficient).

  1. The price must always be shown clearly in close proximity to the phone number and in easily readable form. If the price has a minimum price, it must also be indicated.
  2. If the price of the service increases by more than 50 per cent during six (6) months, the service price must be given at the beginning of the service for at least three (3) months after the price has been increased.
  3. The name of the service provider must be the same as is given in the company’s trade register, or it can also be a registered auxiliary business name. No abbreviations are allowed to be used.

MO P-SMS

1. Mobile Originated Premium SMS (MO P-SMS) can be used for mobile phone centric services and applications. This means content delivered and consumed on the mobile phone. It is not possible to use MO P-SMS for internet based services because those services are not consumed on the mobile phone.

2. The consumer has to be informed about the total price of the service and the total number of MO P-SMS he hasto send. The consumer also has to be informed that the ordering SMS will be billed by the Operator.

3. Max Tariff for P-MO SMS 2,00 EURO.

MT P-SMS

1. Mobile Terminated Premium SMS (MT P-SMS) can be used for mobile phone centric services and applications and internet based services. This means content is delivered and consumed on the mobile phone or via PC. The consumer has to be informed about the total price of the service. The consumer also has to be informed that the ordering SMS willbe billed by the Operator.

2. P-MT SMS above 2,00 EURO require hand shake.

General terms:

  1. The price of the service to be used must be continuously visible, easily discernable and clearly legible or otherwise indicated in a prominent manner in direct connection with the input field for the users. It is not permissible to establish the direct connection by using an asterisk symbol (*). Costs are to be listed as gross prices in EUR per individual service and/or per time interval. The currency may only be displayed as follows: EURO, EUR, or €. The price itself must be shown to two decimal places after the decimal point, except for whole euro amounts. Amounts < EUR 1 may be stated in cents and labeled “cent” or “ct.” Price information must be at least as large as the font size used for entering the mobile phone number, but no smaller than 10 points.
  2. In case of using WAP applications or WAP billing, the service provider must indicate the price of the service in a clearly legible manner in the middle of a separate confirmation WAP page after the user has selected the service and authenticated himself, and this must be done in such a way that the price indication can be seen on the displays of all common mobile phones without scrolling. The user must confirm this price indication from his mobile terminal. The payment cannot be initiated until this confirmation is made.
  3. The transaction (payment) window must take up at least one-fourth, and no more than three-fourths, of the screen area, centered in the on-line application being used. 
  4. It is strongly recommended not to use operator names in URLs
  5. You have to send spending notifications to customers: for one-off services – after each 50 EUR spent, for subscriptions – after each 20 EUR spent

Advertising

  1. TV advertisements. The price details should be provided in a clearly legible manner and displayed continuously as long as the short code is shown. In Germany, the resolution of TV pictures is 768x576 pixels. The price information must be at least 50 pixels away from the sides and at least 40 pixels away from the upper and lower edges. The minimum font size should be 20 points. Gothic (sanserif) font with a shadow that is clearly set off from the font color should be used for font sizes of up to 30 points. The price information should be in the same horizontal line in direct connection with the short code advertised.
  2. Print media. The price details should be provided in a clearly legible manner in a minimum font size of 7 points in direct connection with the call number, unless the advertisement is aimed at minors as a target group. In case of poster advertisements or anything of a similar nature, the minimum font size should be correspondingly larger. In advertisements for value-added telephone services addressing minors as a target group, the price details in print advertisements should be provided in a clearly legible manner in a minimum font size of 10 points and in direct connection with the advertised number.

Requirements for special types of services:

  1. Quiz, Raffle, Voting and SMS2TV
    • For those services it is not required to return a MT SMS to the consumer to complete the billing.
    • For Raffle and Quiz all consumers should be able to participate with equal chance to win (same conditions).
    • It is not allowed to offer this service only in case a consumer has purchased a product.
    • Alternative methods to participate have to be offered with the concept that “all should be able to participate".
    • Max tariff 0,50 EURO
  2. Chat services are under close supervision by operators and regulatory institutions.

    Chat Services are MO billed.

    Type of Chat has to be clearly communicated according to the FST. Moderated Chat or real Chat partner Welcome message is mandatory.

    The Welcome SMS has to contain the following information and should be easily to understand. (No abbreviations):

    • Name of service provider
    • Description ofservice
    • Price per MO SMS

    Example Text:

    Welcome to the Chatservice from <Name of Content Provider>. We offer <Free text> .<This Chat services is moderated by professional agents>. Price pro MO SMS x,xx EURO.

  3. Erotic services are available, full adult is forbidden.
  4. Sweepstakes Sweepstakes / Lotteries are closely monitored by operators in market DE. According to german law it is not allowed to offer "Sweepstakes / Win a price" and to mandatory combine it with payment for a service. The service has to offer the possibility to win a price without subscribing or paying for the service. Moreover, such services need approval which is possible if the website owner sends a legal letter of comfort (a lawyer "guaranteeing" the legal compliance) along with the service description.

TERMS for your website:

After entering the phone number the end user has to actively approve the terms and conditions.

There are 2 ways of doing this:

  1. Checkbox- adding a checkbox that says that the end user knows the costs of the service and have read the terms and conditions and agrees to them.Without approving the terms and conditions the end user won’t be able to continue with the registration process.This is the recommended wording in English:I’ve read and understood the service regulations and costs and I agree to them.This is the recommended wording in Hebrew: קראתי והבנתי את תקנון השרות ואת פרוט השרותים ועלותם ואני מסכים להם .
  2. Adding a sentence before entering the password that says:To approve the service conditions and costs at the bottom of this page please enter the password that was sent to your phone number. The sentence in Hebrew: כדי לאשר את תנאי השירות ועלויותיו הנמצאים בחלקו התחתון של העמוד אנא הזינו את הסיסמאשנשלחה אל המכשיר הנייד שלכם.

Toolbar for terms of service

  • Each landing page should contain a “terms of service” toolbar.
  • Pressing each one of the buttons on the toolbar in the process of registration will present the relevant information according to the suggested service.
  • Under the toolbar should be explicitly mentioned the essence, the cost and frequency of the service in a font no smaller than 11pts in Arial style.

    For example:

    This is a subscription landing page to a <service description- E.g. trivia> service thatallows the end user to get <the return for the premium messages- E.g. an iPhone 4>.This is a <the frequency> renewable service <the costs of the service>.

    In Hebrew:

    זהו אתר רישום לשירות <שם השירות> המאפשר זכייה ב <תמורה עבור הודעות פרימיום>.זהו שירות <תדירות השירות> מתחדש בעלות <עלויות השירות>.

Mention of the service cost

  • Each mention of the service cost should be written in digits and not in letters. For example, it should be written “10 NIS”, not “ten NIS”.
  • If an additional cost might apply (such as for surfing the internet from the mobile phone) it should be mentioned explicitly.

This tab should present all of the prices and costs of the service in a clear and full manner. Allprices should be written in digits and not in words.

This tab should present the ways to disconnect from the service in a clear manner (for subscriptions)

Toolbar – Customer Service-

This tab should present the information on the service provider and contact information in aclear manner.

Toolbar – Supported Devices-

This tab should present the supported devices and the limitations of the use in theservice in a clear manner (mentioning not supporting devices etc…).

Toolbar – Regulation-

This tab should contain a link to the regulations of the service and it is possible to write specialservice terms that should be pointed out.


Advertising rules
  1. The advertising media has to follow the following rules:
    1. Landing page has to present the essence of the service.

      For example: trivia, credit to enter and download content from a website, words game etc…

    2. The landing page has to present the frequency of the service (for subscriptions).

      For example: monthly/ weekly/ daily etc…

    3. The information should be placed up to 0.5 cm from where the end user writes his phone number.
    4. This information’s font size has to be at least ARIAL 11
  2. Landing pages should show all text (including the text under the toolbar) in one framesuited to the resolution 1024X768. For avoidance of doubt, all the information has to appear in the same page where the customer sees the advertising of the service without the need to scroll the page.
  3. Text color - all text that is required here must be in a contrast to the page background.
  4. All text that is required here should appear in every sale channel (digital media, written media, voice media etc…).

Regulations for specific types of services:

Adult services are available, but it is necessary to check end user age (18+). This check should be performed before starting the registry process.

To use this check the end user has to enter his ID (social security number) and Birth Year.

By using this data you can get an indication that the end user age is (18+).

The way to do it:

1. When end user enters his phone number you should also request for ID and Birth Year,

you can make this check before sending the password to the end user.

2. Adding a sentence before entering the ID and Birth Year that says:

To approve that you are the age of 18 or above please enter your ID and Birth Year.

The following requirements are for subscription services:


  1. When subscribing an end user through a web site a double opt in method is required.
  2. Subscription informing message:When sending the PIN code to the end user the following text should be used: השירות בתשלום וכפוף לתנאיו XXXXXX להצטרפות לשירות הזן באתר את הקודTranslation: to subscribe to the service enter the pin code XXXXXXX this is a premium service and according to its rules and regulations.
  3. Successful subscription message:After a successful subscription, whether it was via MO opt in or web double opt in, the end user should get a message informing him that the subscription was successful. The message should contain the following information:
    1. This is a renewable subscription service
    2. The cost of the service
    3. How to cancel the subscription

  1. A content supplier cannot charge for delivery of a service through several transactions. The supplier must therefore use defined rates, and only charge the consumer once. For example, content suppliers cannot use several transactions to exceed the defined tariff. Content suppliers must not charge a consumer for a content service before the service has been delivered to the consumer’s telephone. If the consumer downloads the same content service twice, no charge should be placed on the second download as long as it is completed within an hour of the original download.
